1. Purpose
These Terms and Conditions of Sale govern the online sale of digital products offered by Isabelle Berthier (hereinafter referred to as the « Artist ») through her website.
By placing an order, the Customer acknowledges having read and accepted these Terms and Conditions without reservation.
The Artist reserves the right to modify these Terms and Conditions at any time. The applicable Terms and Conditions are those in force on the date of purchase.
2. Digital Products
All products sold on the website are digital files created by Isabelle Berthier. No physical item will be shipped.
Product images and descriptions are provided as accurately as possible. However, colours may vary depending on screen settings and printing methods.
Once payment has been completed, Customers will receive access to download the purchased files.
3. Intellectual Property and Licence
All digital products are protected by copyright and remain the exclusive property of Isabelle Berthier.
The purchase of a digital file grants the Customer a non-exclusive, non-transferable licence to use the file in accordance with the licence terms specified on the product page.
Unless otherwise stated, Customers may not:
resell, share, distribute, sublicense, or give away the original files;
claim the designs as their own;
upload or make the files available for download on any platform;
reproduce or redistribute the files in digital form.
Ownership and copyright remain with Isabelle Berthier.
4. Prices
All prices are stated in Euros and include all applicable taxes.
The Artist is not subject to VAT under Article 293 B of the French General Tax Code. Therefore, VAT is not applicable and will not appear on invoices.
The Artist reserves the right to change prices at any time. Products are billed according to the prices in effect at the time of purchase.
5. Formation of the Contract
Validation of an order constitutes acceptance of these Terms and Conditions.
The Customer undertakes to provide accurate information when placing an order.
The contract language is English.
The Artist reserves the right to refuse or cancel an order for legitimate reasons.
6. Payment
Payment is made securely through the payment methods available on the website.
The order will be processed only after full payment has been received.
7. Delivery of Digital Products
No physical delivery is involved.
After payment, Customers will receive a link or access to download the purchased files.
It is the Customer’s responsibility to save and back up their files after download.
The Artist cannot be held responsible for download problems caused by the Customer’s internet connection, device, or software.
8. Right of Withdrawal and Refund Policy
In accordance with Article L221-28 of the French Consumer Code and applicable European legislation, the right of withdrawal does not apply to digital content supplied electronically once performance has begun and the Customer has expressly consented to immediate access to the content and acknowledged the loss of the right of withdrawal.
Due to the nature of digital products, all sales are final.
No refunds, exchanges, or cancellations will be granted once the files have been downloaded, except where required by applicable law.
If a file is defective or corrupted, the Customer should contact the Artist, who will provide a replacement file.
9. Limitation of Liability
The Artist shall not be liable for any indirect damages resulting from the use or inability to use the digital products.
The Customer is solely responsible for ensuring that the files are compatible with their software and equipment.
10. Personal Data
Personal information collected during the ordering process is used solely for processing orders and complying with legal obligations.
Customers have the right to access, rectify, or delete their personal data by contacting the Artist by email.
Customer information will never be sold or disclosed to third parties except where required by law.
11. Applicable Law
These Terms and Conditions are governed by French law.
In the event of a dispute, the parties shall seek an amicable solution before initiating legal proceedings.
Failing an amicable agreement, French courts shall have jurisdiction.
